When “rounding up” can be a problem • If a store always rounds up instead of using a neutral rule, it can be treated as an undisclosed price increase or overcollection of sales tax, which can violate consumer protection or tax laws.[hklaw +2] • Some guidance for businesses warns that, absent clear law, they should at least round down on cash transactions if pennies are unavailable, to avoid claims that they are overcharging customers.[complyauto +1] Practical takeaway • A retailer is usually allowed to round a cash total when pennies truly are unavailable, but it must follow whatever rounding rule its state requires or recommends (often nearest‑nickel, up or down) and still compute tax to the exact cent.[avalara +2] • A store policy that simply “rounds up every time” on cash sales is risky and may be illegal where you live; the safest practice is neutral or customer‑favorable rounding clearly disclosed at the point of sale.
